A compensation claim can be filed when he/she suffers due to the carelessness of others. All types of sufferings- physical, psychological, personal or financial are included when pursuing compensation claims. The value of the compensation depends on how these sufferings were caused; who & what caused them and the type of scenario the claimant was in.
Public Liability Compensation Claims
If a child is playing on a swing in a public park and the swing breaks suddenly, injuring the child. As parents, people can file public liability compensation claims against the local civic authority responsible for park maintenance. Similarly, while shopping at a local store, someone slips on a wet floor and suffers injuries due to the fall and if there is no cautionary ‘wet floor’ sign placed, the injured person is allowed to file a personal liability compensation claim against the store owners.
A public liability claim is when a person has suffered an injury through the fault of another party in a public place.
Road Accident Compensation Claims
If someone gets hit by a vehicle while walking on the footpath and receives serious injuries like an arm or a hip fracture, he/she is eligible to file a road accident compensation claim. Similarly, if while driving someone’s car gets hit by another person’s negligence, this would again qualify as a road accident compensation claim. In these scenarios, the claimant knows who’s responsible for the mishap and is eligible to receive suitable compensation for the damages incurred.
Medical Negligence Compensation Claims
If a person suffers due to negligence on part of a medical professional or an institution, he/she is entitled to file a medical negligence claim and receive compensation for the sufferings. Medical negligence occurs in cases like misdiagnosis, non-diagnosis, drug overdose, incorrect medication & errors committed by medical professionals during surgery. This often leads to unbearable pain, permanent injuries, financial losses and mental trauma- which could have been avoided if medical staff was careful in their approach.
Criminal injury claim
A man was recently found guilty of attacking his ex-girlfriend & was asked to pay 150 GBP in compensation claims. The Leicester-based man took her for a countryside drive and attacked her near King’s Norton on the Guaulby Road. The woman suffered facial injuries due to the assault.
The prosecutor, as quoted by This Is Leicester, told the court: "The defendant assaulted her as they sat in the car because he could not accept the relationship was over. He continued to punch her despite her pleading with him to stop and apologizing for ending the relationship. She managed to get out of the car but the defendant continued to abuse her."
The man’s lawyer said, "My client is full of remorse and has no previous convictions." Apart from compensation, he has been put on 2-year supervision and ordered to complete a domestic abuse program.
Whatever may be the suffering, if it’s caused due to someone else’s fault, one should consider filing compensation claim against the responsible party.
