Dui Laws For Delaware

The state of Delaware has used a declaration that DUI cases are going to be targeted. The state is cracking down on drunk drivers, so you need to know the law. The best way to protect yourself is to never drive while under the influence, but if you do, here is what you can expect to face afterwards.

First, after your arrest, the Division of Motor Vehicles is going to take away your driver's license. You have to file a request for a hearing within 15 days of your arrest if you want to argue for your right to drive. You will be given a temporary license to use during those 15 days. If you do not request the hearing before the temporary license expires, your license will automatically be suspended.

If you are convicted of your first DUI offense, the state of Delaware will charge you up to $1,150 in fines. You could also face up to six months of jail time. All DUI offenders are required to pass a DUI education course, and you will have to pay for this out of your own pocket.

Besides the fines and education costs, you will lose your right to drive as well. Most first time offenders lose their licenses for three months. However, if you refuse to take a BAC test or if you caused an accident while driving drunk, this suspension could increase.
